Madison – Yesterday, U.S. District Judge Mazzant halted the overtime rule that President Obama’s Labor Department issued earlier this year. The new rule was to go into effect on December 1, and would have more than doubled the level at which employees are exempt from overtime pay from $23,660 to $47,476. Industry groups and 21 states, including Wisconsin, had sued to stop the rule.
Below is a statement by Kurt Bauer, WMC’s CEO/President.
“President Obama’s Department of Labor overstepped their authority when they issued new overtime rules earlier this year. Simply put, federal agencies must act within their authority as delegated by Congress, and in this case they did not. Employers can now breathe a sigh of relief, but there is still the uncertainty of what happens next as the court case proceeds. Ultimately, the decision will be with the incoming Trump Administration and the Republican Congress whether to change the overtime standards or not.”
