Personal Injury Trust Claims Transparency – Cosponsorship of LRB-0002

Dear Members of the Legislature:
Please consider contacting Sen. Glenn Grothman and Rep. Andre Jacque to co-sponsor LRB-0002, which will ensure greater transparency in lawsuits involving personal injury trusts.
Over the past few decades numerous manufacturers established trust funds to compensate victims, including those harmed by asbestos.  Unfortunately, some plaintiff attorneys have exploited these trust funds through “double dipping” – receiving payouts from one or more trusts and then suing solvent companies that may only have had a peripheral involvement with asbestos.
LRB-0002 would address this potential fraud by requiring greater transparency during the discovery process when a plaintiff files a lawsuit against a solvent business.  LRB-0002 does not take away a victim’s ability to be properly compensated.
Attached is a recent Wall Street Journal editorial which discusses a similar law that was recently enacted in Ohio.  Wisconsin should follow Ohio’s lead by introducing and passing a similar law.
